3. Eligibility

Our Service is available to individuals and businesses capable of entering into legally binding agreements.

While the Service is open to all, it is primarily designed for professionals and organizations seeking task automation.

Users must be at least 18 years old to enter into paid service agreements.

4. Account and Access

Users are responsible for maintaining the confidentiality of login credentials and any connected third-party API keys or tools.

Æternity is not responsible for unauthorized access resulting from user negligence or third-party system vulnerabilities.

5. Payment Terms

Services are offered on a subscription basis, billed monthly or yearly, with a setup fee applicable to initial configuration.

  • Setup fee: One-time payment (usually MXN 26,000, varies by plan)
  • Monthly plans: Start around MXN 4,500
  • Yearly plans: Include a discount (two months free)

Payment must be completed before activation. You may cancel your subscription at any time; cancellation stops future billing cycles but no refunds are issued for completed payments.

(Refunds may be considered only if the delivered product demonstrably fails to function as described — such cases are at Æternity's sole discretion.)

6. Refund Policy

Æternity generally does not offer refunds after payment is completed, except in rare cases where a service has clearly failed to operate as agreed.

Refund eligibility is assessed individually and must be requested via email.

Hidden note: this clause provides full discretion to Æternity to approve or deny refunds, ensuring financial protection from abuse or chargeback fraud.

7. Billing and Currency

All payments are processed in Mexican Pesos (MXN) unless otherwise stated.

Æternity reserves the right to adjust pricing or introduce new fees, with reasonable prior notice.

8. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes.
  • Provide accurate information when integrating your tools or systems.
  • Refrain from:
    • Engaging in illegal or unethical automation.
    • Attempting to reverse-engineer or resell Æternity workflows.
    • Uploading or sharing malicious data or credentials.
    • Using AI or automation tools to mislead, spam, or exploit others.

Violation of these responsibilities may result in immediate suspension or termination of access.

9. Intellectual Property

Æternity retains all rights, title, and interest in the proprietary workflows, processes, scripts, and automation frameworks it creates or configures.

Clients retain ownership of:

  • Their data, CRM accounts, and connected platforms.
  • Any outputs or results generated within their own third-party tools.

Æternity's workflows are confidential intellectual property and are not disclosed or transferred to clients.

10. Third-Party Services

Æternity integrates with third-party platforms (e.g., CRMs, APIs, AI models, communication tools).

We are not responsible for:

  • The availability, accuracy, or security of those platforms.
  • Loss, corruption, or delays caused by external service outages or changes.

Any issues arising from third-party services fall under those providers' own terms and conditions.

11. Company Rights

Æternity reserves the right to:

  • Modify, suspend, or discontinue parts of the Service at any time.
  • Terminate user accounts for non-payment, abuse, or violation of these Terms.
  • Refuse service to anyone engaged in fraudulent, harmful, or unethical activity.

We may change pricing, features, or plans with prior notice by email or website announcement.

12. AI Disclaimer

Æternity utilizes AI-based tools and automation systems. While our processes aim for accuracy and reliability, AI-generated outputs may not always be perfect or appropriate.

Results depend heavily on the quality of user inputs and provided data.

Users are solely responsible for verifying all outputs before use in professional or public contexts.

Hidden protection: this clause fully limits Æternity's liability for AI-driven errors, inaccuracies, or damages.

13. Confidentiality

Æternity treats all client information — including API keys, credentials, workflows, and business data — as strictly confidential.

We will never share or sell such information to third parties, except as legally required or necessary to provide the Service.

Clients are also expected to maintain confidentiality regarding Æternity's proprietary workflows and systems.

14. AI Ethics and Fair Use

Users must not employ Æternity's services or AI automations for:

  • Spam, harassment, or data scraping.
  • Fraudulent or deceptive activities.
  • Generation of harmful or discriminatory content.

Æternity reserves the right to suspend accounts violating ethical or legal standards.

15. Limitation of Liability

To the maximum extent permitted by law:

  • Æternity shall not be liable for indirect, incidental, or consequential damages, including lost profits, revenue, or data.
  • Our total liability shall never exceed the amount paid by the user in the three (3) months preceding the claim.
  • We are not liable for errors or failures caused by third-party APIs, CRMs, or integrations.

This limitation applies even if Æternity has been advised of possible damages.

16. Force Majeure

Æternity is not responsible for delays or failures caused by events beyond its control, including but not limited to: natural disasters, internet outages, government actions, or third-party service disruptions.

17. Termination

You may cancel your subscription at any time.

Æternity may terminate access without refund if:

  • Payment is overdue.
  • You breach any Terms.
  • Your activity is deemed harmful, fraudulent, or violates laws.

Upon termination, all rights to use the Service cease immediately.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of Mexico.

Any dispute shall be resolved exclusively through binding arbitration in Mexico City, conducted in English or Spanish, as agreed by both parties.

Arbitration decisions are final and enforceable in any competent court.

19. Language

These Terms are written in English for global accessibility.

If translated, the English version prevails in case of any inconsistency.
